Every so often, a business owner reaches out to us frustrated with their current marketing agency or team. Their website isn’t performing the way they need it to, their current agency isn’t fixing it fast enough, or the relationship has just run its course, and they’re ready for a change. Then comes the hard part: they find out they don’t actually own their website. Their agency does. And leaving means starting over from zero, or it turns into a slow and expensive process just to get out of the relationship. We’re going to show you how to choose a web design agency who has your business’ best interest in mind, not only their bottom line.

If you’re in the process of choosing a web design agency, or you’re thinking about switching from one you’re already with, there’s one question almost nobody asks upfront, and it can save you a massive headache down the road. Who will actually own the website when it’s done?

Here’s what’s really going on when an agency owns your site, why it matters more than most business owners realize, and how to find out where you stand.

What “the agency owns your site” actually means

When you hire someone to build your website, there are a few things that determine who’s really in control of it: who owns the domain name, who controls the hosting account, and who has the login to the platform your site is built on. If any or all of those live under your agency’s accounts instead of yours, they own your website, not you. You’re essentially renting it, even if you paid to have it built.

Most business owners don’t think to ask about this upfront, and honestly, why would you? You’re hiring an agency because you trust them to handle the technical side. But that trust can turn into a real problem down the road.

The first question to ask when choosing a web design agency: who will own it?

Maybe the service slips or the performance stalls. Maybe the team you liked working with moves on and you get handed off to someone new. Whatever the reason, when you’re unhappy with an agency that owns your site, your options shrink fast, and you can’t just take your website and go. Getting it back, if you can get it back at all, is often slow, complicated, and expensive. Some business owners end up paying what amounts to a ransom just to access their own site, and others give up and rebuild from scratch, losing years of content and design work in the process.

Either way, you’ve lost your leverage, and an agency that knows you can’t leave has very little incentive to keep you happy. Before you sign with anyone, it’s worth asking directly: when this site is built, whose name is it actually going to be in?

Why ownership matters more than most agencies let on

This is the part we feel most strongly about. Your website isn’t just a marketing expense. It’s an asset, the same way your equipment, your client list, or your inventory is an asset, and it carries real value because it represents work, money, and time you’ve invested in your business. Like any real asset, it’s something you should be able to keep, grow, borrow against, or even sell, because it’s yours.

When an agency builds your site under its own ownership, it isn’t really building an asset for your company. It’s building one for its own, using your business as the reason to do it, and we think that’s backwards. We aren’t in the business of building website assets for ourselves. We’re in the business of helping your business grow, and that only works if what we build actually belongs to you.

A few more things to check before you sign with any agency

  • You could lose more than your website. You could lose your rankings too. Years of SEO work, including your search rankings, your backlinks, and your page authority, is often tied to the domain and hosting setup, not just the content on the page. If your site gets pulled or migrated poorly when you leave an agency, that equity can disappear with it. We’ve seen businesses lose most of their organic traffic simply because the technical handoff wasn’t done right, or wasn’t possible at all.
  • You lose your negotiating power. An agency that owns your website never has to worry about losing you as a client, and that changes how they price you, how quickly they respond, and how hard they work to keep your business.
  • You’re exposed to their business, not just your own. Agencies get acquired, change ownership, raise their prices, or sometimes just go quiet, and if any of that happens while they’re holding your website hostage, it becomes your problem too, even though it has nothing to do with how you run your business.
  • You risk losing your website altogether, even if only temporarily. If you’re not able to get your site transferred cleanly, you could end up with no website at all during the transition, or significant downtime while things get sorted out. And every day your site is down or inaccessible is a day you’re not showing up in search, not capturing leads, and losing the traction you’ve already built. For a lot of businesses, the website is doing real work every day, generating calls, forms, and bookings, and losing that, even for a short stretch, has a real cost.

How to tell if your current agency owns your site

You don’t have to guess. A few quick things to check:

  • Who is listed as the registrant on your domain, you or your agency? You can look this up through a WHOIS search.
  • Do you have your own login to your hosting account, separate from your agency’s?
  • Do you have admin access to whatever platform your site is built on?
  • Could you export your own content and files if you needed to?

If you answered no or I don’t know to any of these, it’s worth asking your current agency directly.

Already locked in? Here’s what to do

First, don’t panic. This is more common than you’d think, and it’s usually fixable. Start by asking your agency directly for access to your domain, hosting, and platform login. A reasonable agency will work with you on a transition, even if it takes a little time and some added cost. If they resist or make it difficult, that alone tells you a lot. From there, you may want to loop in a new web partner who can help you understand exactly what it will take to safely move your site without losing your content, your design, or your search rankings in the process.

What to look for instead: how we do it

Every website we build, you own from day one. That includes the domain, the hosting, all of it. If you ever decide to work with someone else, or bring things in-house, you can take your website with you, no negotiation required. That’s not a policy we added to sound generous. It’s just how we think a website should work. It’s your business, so it should be your asset.
